Our National Tax Office works with other accountants to deliver specialized knowledge in a variety of service areas including IRS disputes in common areas such as high net worth, complex IRS audits, and Business Credits and Incentives – specifically, Energy Efficiency Incentives, Research and Development (R&D), and Employee Retention Credit (ERC) issues.

IRS Dispute Resolution & Collections
Eide Bailly’s IRS Dispute Resolution & Collections team advocates for clients helping clients gain peace of mind and confidence in protecting their tax positions. We can assist when a client is in receipt of an IRS notice, penalty letter or under IRS exam to help provide a solution.
Fixed Asset Services
Our Fixed Asset Services (FAS) team provides organizations with a comprehensive and proactive approach to realizing material deductions and credits that are afforded through the built environment including energy efficiency incentives. Our industry-leading Energy Incentive Program allows you to identify and claim available incentives, reducing confusion and complexities. We help organizations identify if they can benefit from the Investment Tax Credits under Section 48, Production Tax Credits under Section 45, Residential Energy Credit (Section 45L), Building Energy Deduction (Section 179D) and the Utility Sales Tax Exemption.
Research & Development Tax Credits
The R&D Tax Credit team works with organizations to determine whether or not they qualify for the credit. Many organizations can benefit from the R&D tax credit merely through their efforts to stay competitive by improving existing products and services and developing new ideas. Depending on the nature and timing of these investments, organizations may benefit from the R&D tax credit.

- Explain the process of an examination and the keys to presenting and protecting your client’s evidence.
- Identify the issues commonly raised by the IRS including conservation easements, captive insurance, reasonable compensation, large losses, material participation, ERC and R&D Credits.
- Discuss the IRS Global High Wealth examination campaign audits targeting wealthy taxpayers.
- Explore updates on IRS collections and changes to IRS procedures.
- Introduction to potentially $1.2 trillion ($120 billion per year) in energy incentives over the next ten years within the Inflation Reduction Act of 2022.
- Review the Inflation Reduction Act enhancements of the Residential Energy Credit (Section 45L) and Building Energy Deduction (Section 179D).
- Outline examples of how energy incentives can be implemented into your clients’ tax cashflow strategy.
- Review how organizations qualify for and benefit from the R&D tax incentives and the Employee Retention Credit (ERC).

Ben Peeler, J.D., CPA, LL.M., Partner/IRS Tax Controversy Practice Leader
Ben joined the firm early in 2014 with many years of tax experience, both as an attorney and an accountant. He specializes in federal tax, controversy and procedure work, assisting clients in the areas of income tax, estate and gift tax, property tax, sales and use tax, estate planning and many other tax matters. Ben's vast experience includes representing clients before the IRS, as well as representing the IRS before the US Tax Court and during litigation before the federal district courts as a special assistant to the United States Attorney. Today, Ben leads the firm's IRS Practices & Procedures as a federal tax, controversy and procedure specialist and serves on Eide Bailly's National Tax Office team that is committed to helping clients resolve their tax issues.
Joe Sawatske, HERS Rater, Principal/Energy Incentives
Joe has over 15 years of experience in helping taxpayers realize tax incentives through the construction, renovation and design of energy efficient real estate. As the head of Eide Bailly’s Energy Efficiency Incentives (EEI) group, Joe oversees a national team of Professional Engineers, energy modelers and HERS Raters. The growing EEI group has extensive experience in performing 179D deduction, 45L credit and ENERGY STAR studies.
Jesse Wutkee, CPA, Partner
Jesse provides tax consulting services to clients throughout the country. He helps clients benefit from research and development tax credits at the federal and state level spending a majority of his time in the technology, manufacturing, construction and agriculture industries. He represents clients before federal and state tax authorities to support their R&D credit claims.
Jim Wessel, J.D., M.B.A., Business Development Director
Jim develops and nurtures relationships with external accounting, tax and other professional service providers to virtually broaden the services they can offer through a trusted referral relationship with Eide Bailly. He advises referral relationships on the variety of services that Eide Bailly offers and works closely with the referral client to find solutions and provide requested advice.
